[Open session]
-
Your Honour, we're in open session.
-
Thank you, Madam Court Attendant. For purposes of record and the public forum, even though it's deserted, we will have that on record, please, Ms Alagendra.
-
[Closed session]
-
[The accused present]
-
[Upon commencing at 9.30 a.m.]
-
[At this point in the proceedings, a portion of the transcript, pages 5154 to 5209, was extracted and sealed under separate cover, as the proceeding was heard in closed session.]
-
Your Honour, the next witness is TF1-337. This witness was previously subject to protective measures granted by another Trial Chamber in July of 2004 and for this trial the witness has opted to testify openly.
-
Ms Alagendra, the protective measures to which this witness was subject were in open session, were they not?
-
I don't understand that, your Honour.
-
You are applying for this witness to now testify in open session, but I'm saying that he or she was in fact going to testify in open session anyway, so what is your application actually?
-
No, your Honour, this witness was subject to --
-
What measures?
-
-- an order by the other Trial Chamber which included a pseudonym and a screen.
-
Yes, but that's still in open session.
-
But for this trial he's going to go completely open with no protective measures, your Honour.
-
That is what you should ask for; to rescind the existing protective measures.
-
I stand guided, your Honour, thank you.
-
Very well. The witness has sought to rescind or vary the previous protective measures and in the light of his or her application the Court hearing will proceed in open session without the protective measures previously granted.
-
Madam President, the Defence have no observations to make on this. It was obvious to the Court I'm sure that we would have no observations, but I just thought it appropriate to confirm that. No offence at all was taken.
